Terms of Use

1. Purpose and acceptance

These terms govern the use of the websites aytechnet.com and aytechnet.fr and of their customer area, operated by AYTECHNET (SARL, RCS Aurillac 502 088 792 — see the Legal Notice). Browsing the site, creating an account or signing in implies acceptance of these terms.

2. Relationship with the terms of sale

The services Aytechnet provides to its customers (website creation, development, hosting, domain names, supervision, maintenance…) are governed by the accepted quote and Aytechnet's General Terms of Sale (CGV) and their schedules, provided with each quote. These terms only cover the use of the site and of the customer area; in case of conflict regarding a service, the quote and the CGV prevail.

3. Account

• An account is created with an email address and a password, or at the first sign-in with Google or GitHub; in the latter case the use of that provider is also subject to its own terms.
• You provide accurate information and keep your credentials confidential. Actions taken with your account are deemed to be yours; report any suspected unauthorised use to contact@aytechnet.fr without delay.
• An account is personal. Accounts shared between several people are not allowed: each person of a customer company uses their own.

4. Customer area

• Having an account does not by itself give access to any service. Your account shows the services of an Aytechnet customer only when your email address matches that customer or one of its contacts in Aytechnet's records. The customer decides who has access by keeping its contacts up to date with Aytechnet; access ends when a person is removed or when the relationship ends.
• Actions taken in the customer area (in the supervision: creating an organisation or a server group, regenerating an enrollment key, removing a machine, acknowledging an alert) are taken on behalf of the customer company, which is responsible for them towards Aytechnet. They are recorded (author, date and, for an acknowledgement, the reason given).
• An enrollment key lets a server join the customer's supervision: keep it confidential, and regenerate it if it has been disclosed.
• Acknowledging an alert hides it until its deadline or until the situation gets worse: it does not fix the underlying problem, and remains the responsibility of the person acknowledging it.

5. Acceptable use

• use the site in accordance with its purpose and with the law;
• not attempt to access accounts, data or services that are not yours, nor to circumvent the security mechanisms or the anti-abuse protections (forms, sign-in);
• not disrupt the site (overload, automated mass requests, intrusion attempts) nor extract its content automatically;
• not register third parties to the newsletter or create accounts with an identity that is not yours.

6. Availability

Aytechnet strives to keep the site and the customer area available, without any guarantee of continuous access: they may be interrupted for maintenance, updates or incidents. Commitments on the availability of the services themselves (hosting, supervision) are only those stated in the quote and, where applicable, in Schedule A of the CGV. The supervision is a monitoring aid: it replaces neither backups nor the customer's own vigilance (CGV Art. 11.7).

7. Intellectual property

The site, its contents and its software remain the property of Aytechnet or of their respective owners; no right is transferred to you beyond consulting them for your own needs. Rights on deliverables produced for a customer are governed by Article 7 of the CGV.

8. Liability

The information published on the site is provided for general information and may change. Aytechnet cannot be held liable for damage resulting from a use of the site contrary to these terms, nor from the disclosure of credentials or enrollment keys by their holder. For the services, Aytechnet's liability applies within the limits of Article 11 of the CGV.

9. Suspension and closing of an account

Aytechnet may suspend or close an account used in breach of these terms, after notice except in urgency (security of the site or of customers' data). You may request the closing of your account at any time at contact@aytechnet.fr; the traces of actions taken on behalf of a customer are kept for the durations stated in the Privacy Policy.

10. Personal data and newsletter

The processing of your personal data is described in the Privacy Policy (/privacy-policy). Subscribing to the newsletter is optional, confirmed by email, and can be withdrawn at any time.

11. Changes

Aytechnet may amend these terms; the applicable version is the one published at the date of use. Continuing to use the customer area after a change means accepting the new version.

12. Governing law and disputes

These terms are governed by French law. The parties first seek an amicable solution (contact@aytechnet.fr). Between professionals, any dispute falls under the exclusive jurisdiction of the Commercial Court of Aurillac, as provided by Article 15 of the CGV; for any other user, the ordinary rules of jurisdiction apply.
